They got away with it because they were given permission by LEGO to do it.

The point is, you do not own the rights. Whoever developed LI's sequels got the go-ahead from LEGO regardless of whether they created the series or not, they still own the rights. If you were to make a game based on someone else's IP and SELL IT, that is called copyright infringement and is very, very illegal. Don't do that.

Because you develop a game does not mean you own the rights to it.

Because LEGO comissioned them to make it. Mindscape doesn't own it either, they just created the game for LEGO. Also, see my whole post in your introduction topic for why everything is wrong.

True, it will, somehow, support modding, but this will be an actual game you buy from game or a games shop. like mafia 2 or the sims 

Allow me to explain the issue you'd have, in the most relaxed way I possibly could explain.

 

If you tried to sell it instead of make it non-profitable, LEGO would be very outraged, because you aren't the creator of the Lego Island franchise.

 

And I'm sure that you probably don't want a lot of problems on your hands.

The thing is though that Lego allowed silicon dreams to create the newer island games. And mindscape wouldn't have created Lego Island in the first place if Lego didn't allow them

^this. Now you have had several people replying to the same thing. If you post a blog like this you're going to get a lot of comments and using a mod queue just doesn't really work.
